Even if you could get the support of everyone in principle, the administration of a fine on an individual basis would be extremely difficult to implement. Who defines "overweight"? And should it be different based on race (which under current law would be illegal)? Who defines sufficient dieting and exercise efforts? Should there be a medical exemption (for those that were genetically predisposed or who were, say, subject to extended bed rest due to a separate medical condition)? And who proves up that medical exemption? And who should pay the medical bill required to prove up that medical exemption? Just some of the issues off the top of my head that would need to be addressed ...
