It's not illegal in the Japanese example, but frowned upon because a company may face fines if its workforce is out of shape. Some friends and I have discussed this before. If you maintain a healthy weight and exercise regularly, you should be rewarded with cheaper health insurance. If you are overweight and choose not to exercise, your health is at a higher risk and therefore should be reflected in your health insurance. The same principle can be applied to those who choose to smoke.
